Thank you for choosing to use Lensart, a camera tool app focusing on real-time artistic frames, developed and operated by the Lensart Team. These Terms of Use govern your access to and use of the App, including all features, content, and services provided through it. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not download, install, or use the App.
The App is provided free of charge, and no account registration or login is required to access and use all its core functions. Your act of opening, downloading, installing, or using the App constitutes your full acceptance of these Terms and our Privacy Policy. We reserve the right to modify these Terms from time to time, and the updated Terms will be effective once posted in the App. We will notify you of significant changes through a pop-up prompt when you open the App next time. Your continued use of the App after the update constitutes your acceptance of the revised Terms.
You represent and warrant that you are of legal age to enter into a binding agreement (or have obtained the consent of a legal guardian if you are a minor) and have the right to use the App in the region where you are located. By using the App, you confirm that your use complies with local laws, regulations, and these Terms.
To ensure the normal operation of core functions (such as real-time frame overlay, photo shooting, and photo saving), the App will request your consent to access your device's camera and photo album. It is hereby explicitly stated that the App does NOT collect, store, process, or transmit any facial information, facial features, or facial recognition data in any form. We will never use camera permissions to capture or analyze facial-related information, and all camera usage is limited to supporting real-time frame overlay and photo shooting functions only.
You agree to grant these necessary permissions (camera and photo album), and we will only use these permissions in accordance with the scope specified in the Privacy Policy and this Clause. You may revoke these permissions at any time through your device's settings, but this may result in the inability to use certain core functions of the App.
When using the App, you shall not engage in the following behaviors:
Using the App for any illegal, fraudulent, harmful, or infringing activities, including but not limited to capturing, editing, or sharing content that violates the privacy, intellectual property rights (copyright, trademark, etc.), or other legitimate rights and interests of third parties;
Creating, transmitting, or sharing content that is obscene, pornographic, violent, bloody, defamatory, insulting, or otherwise violates public order and good customs;
Reverse-engineering, decompiling, disassembling, modifying, or tampering with the App's code, software, or related technologies, or attempting to bypass the App's security measures;
Using plug-ins, third-party software, or other means to interfere with the normal operation of the App or gain improper advantages;
Using the App to generate or spread malicious code, viruses, or other harmful programs that may damage the device or information security;
Other behaviors that violate laws, regulations, or these Terms, or may harm the legitimate rights and interests of us or other users.
All intellectual property rights related to the App, including but not limited to the App's code, software, design, interface, frame templates, logos, icons, and all original content, are exclusively owned by the Lensart Team. All rights not explicitly granted to you in these Terms are reserved by us. You shall not infringe upon our intellectual property rights in any form.
Any photos, images, or other content created or edited by you using the App is your exclusive property. You retain all legal rights to your User Content, including the right to use, share, modify, or delete it. We do not claim ownership of your User Content and will not use, disclose, or profit from your User Content in any way without your explicit written consent. As stated in Clause 2.2, we do not collect or process any facial information contained in your User Content, and all User Content is stored locally on your device unless you actively choose to share it.
You shall be solely responsible for your User Content. You guarantee that your User Content does not violate any laws, regulations, or the rights of third parties. If your User Content causes any disputes, claims, or losses (including but not limited to compensation for damages, legal fees) to us or third parties, you shall bear full responsibility.
The frame templates provided in the App are licensed to you for personal, non-commercial use only. You may use these frame templates to create photos for personal use or non-commercial sharing, but you shall not reproduce, distribute, sell, lease, or otherwise exploit these frame templates independently of the App for commercial purposes. Without our prior written permission, you shall not authorize any third party to use the frame templates.
The App is provided "as is" and "as available" without any express or implied warranties. We do not make any warranties regarding the App, including but not limited to:
The App will be error-free, uninterrupted, or fully compatible with all devices and operating systems;
The functions, frame templates, or content of the App will meet your specific needs or expectations;
The information or content provided by the App is accurate, complete, or up-to-date;
The security, reliability, or integrity of the App and the data stored locally on your device.
We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App, including but not limited to loss of data, device damage, loss of profits, or claims from third parties. This disclaimer shall apply regardless of whether we have been advised of the possibility of such damages.This disclaimer does not apply to obligations related to the non-collection of facial information as explicitly agreed in these Terms; we shall be liable for intentional or gross negligent acts that violate this obligation.
You may terminate your use of the App at any time by uninstalling the App from your device. After uninstallation, all local data related to the App (excluding photos saved to your device's album) will be deleted. Uninstalling the App does not affect any rights or obligations that have already arisen before the termination.
We reserve the right to suspend or terminate your access to and use of the App at any time without prior notice if we determine that you have violated these Terms, engaged in illegal or harmful activities, or if the App is discontinued or updated due to operational reasons. Upon termination, you shall immediately cease using the App, and we shall not be liable to you for any losses arising from such termination (except for losses caused by our intentional or gross negligence, including but not limited to losses resulting from our violation of the non-collection of facial information obligations).
We may revise these Terms from time to time to adapt to changes in laws, regulations, or the App's functions. When we make material changes to the Terms, especially changes related to the collection and use of user information (including the non-collection of facial information), we will notify you by displaying a pop-up window in the App when you open it next time. If you do not agree to the revised Terms, you should stop using the App immediately. Your continued use of the App after the revised Terms take effect constitutes your acceptance of the changes.
